A question we are frequently asked is “what compensation is a pub entitled to if the road outside or nearby is closed because of roadworks?”
Click here to read a note prepared by the House of Commons Library which sets out the general position – there is no entitlement to compensation particularly if the works are carried out by the Highway Authority.
There may be some scope for compensation from utilities such as gas and water but there appears to be no scope for compensation available from electricity companies.
It is a complicated area. Anybody affected by road works would be well advised to seek professional advice but should bear in mind that compensation appears only to be payable in limited circumstances.
It is always worth consulting your policy of insurance to see whether or not such business interruption is covered by it.
