Over the summer period, we have been busy preparing some toolkits which we think you will find useful when handling grievances or recruiting apprentices.

Following the introduction of the Apprenticeship Levy, we know that more and more schools are recruiting apprentices and the legal landscape can be tricky. To help you, we have summarised the legal pitfalls and prepared two agreements for you to offer to newly recruited apprentices.

Although we want to start the new academic year on a positive note, we know that some of you will need to consider suspending employees during the academic year.

A recent High Court decision of Agoreyo v London Borough of Lambeth has provided a helpful reminder of the steps you need to consider before confirming a suspension from duties.

This case involved a teacher who was suspended because of the force used with two children. She was not asked to respond to the allegations before her suspension was confirmed, nor was the school in question able to show that it had considered alternatives to suspension. The teacher resigned on the same day. The High Court held that the suspension was not a neutral act. It was noted that a knee jerk reaction should be avoided and that suspension must not be the default position. The reason given for suspension was not the protection of the children, but to allow ‘the investigation to be conducted fairly.’

This decision highlights the importance of having clear, sound reasoning for suspending employees, particularly those in the context of a qualified professional in a vocation, such as a teacher.
