DCMS are looking at a potential deregulation through the Red Tape Challenge. Pubs are automatically entitled to offer up to 2 category C or D gaming machines but must first inform the Licensing Authority, provide certain information and pay a £50 fee.
In the event of a change of Premises Licence Holder under the 2003 Licensing Act pubs must ‘re-notify’ the Licensing Authority in respect of their 2 machines at an additional cost of £50. DCMS now believe that this is potentially an unnecessary administrative burden as well as imposing a cost of £50.00 each time a notification is made.
Clearly for a Tenanted Pub Estate where the Premises Licence is held by the Tenant every time the Tenant changes a £50.00 fee is incurred because of the need to re-notify the machines (in most cases). If this measure is introduced there should be a significant saving for business.
