Entertainment deregulation

Last year the Government announced a consultation on the entertainment deregulation of most entertainment activities that require a Licence under the Licensing Act 2003. The Government has just announced the results of that consultation together with the announcement of the measures that it proposes to take.

The Government has indicated that most entertainment activities that are licensable will be deregulated up to an audience threshold of 500 people save for indoor sports which will have a higher audience ceiling of 1000 people. Deregulated activities will have a performance end time of 23.00. Accordingly, the performance of plays and exhibition of dance activities will be deregulated for audiences of up to 500 between the hours of 08.00 and 23.00.

The indoor sport will be deregulated for audiences up to 1000 between the hours of 08.00 and 23.00.

Live music has been deregulated under the Live Music Act since 1 October 2012 In the case of live unamplified music in any location between the hours of 08.00 and 23.00 and in the case of live amplified music on licensed premises or workplaces for audiences of up to 200 people between 08.00 and 23.00. The Government proposes to raise the audience threshold from 200 to 500. It is also proposed at the same time to deregulate recorded music as a licensable activity between the hours of 08.00 and 23.00.

The Government’s argument is that there are other control measures in place which can be used in the event that these deregulated activities cause a nuisance.

There are no proposals at the moment to carry out any further deregulation of films.

Similarly, boxing and wrestling will remain regulated.

There will be further exemptions for Local Authorities (to Parish Council level), hospitals, schools, church halls, village halls and community centres.
