A number of changes to the Licensing Act 2013 will come into effect on the 6 April. Sections 135 to 140 of the Policing and Crime Act bring about a number of changes including the following:
- There will now be a single appeal on 48 hours notice permitted against interim steps for the Premises Licence Holder unless there has been a material change in circumstances.
- The Licensing Authority at the hearing of the full Review following a Summary Review will consider the interim steps imposed and whether they should continue.
- The Licensing Authority will have the power to either suspend for up to six months or revoke a Personal Licence when it becomes aware that the Personal Licence Holder has been convicted of a relevant offence.
There is still no date announced as to when the other changes to the Licensing Act will be introduced, e.g. putting cumulative impact policies onto a statutory footing and also amending the use of late-night levies.
