High value clinical negligence costs litigation

Our client instructed us to pursue damages for a Cerebral Palsy claim against the NHS Trust. We managed all aspects of costs throughout the substantive claim, including effective cost management and successful recovery at Detailed Assessment upon conclusion.

This case was notably complex and ultimately resulted in a settlement exceeding £18m. We navigated two rounds of costs management and advocated for an application to depart from the approved budget at each stage in the High Court. By the end of the case, we prepared a bill approaching £2m in costs. When settlement discussions did not yield results, we conducted the Detailed Assessment, successfully recovering approximately 80% of the profit costs sought, along with significant assessment and advocacy costs.

Through our diligent efforts at every cost stage, we ensured that the claimant had a cost management order in place that adequately addressed the complexities of the case, ultimately achieving highly favourable costs recovery.

Successful project against specific opponent solicitor

Our client reported challenges in achieving cost settlements against a particularly difficult opposing solicitor who was unwilling to engage in meaningful negotiations. In response, we were tasked with launching a strategic project aimed at establishing expertly calculated protective offers early in the process and pushing for assessment when realistic engagement was refused.

Over a two-year period, we managed approximately 45 cases. From these, we successfully secured favourable settlements in 11 cases, while the remainder proceeded to assessment. During the assessment phase, we succeeded in all but 15 cases. For those 15 cases that did not go in our favour, we escalated each one to oral appeal hearings and won in every instance, receiving costs associated with these appeals as well.

By the conclusion of this project, our previously difficult opponent began to engage in meaningful negotiations from the outset. They now recognise that with FB Costs involved, every potential cost argument will be thoroughly explored and leveraged to achieve the most favourable outcome for their client.
