About driving while using a mobile phone

You are considered to be committing a driving offence if you are found using a mobile phone or other handheld devices, such as a laptop, tablet or sat-nav while driving. However, there is no real definition of ‘using’, meaning you could be pulled over for simply checking the time or moving your device.

The penalties

It may seem like a small offence compared to other crimes but penalties for driving while using a mobile phone can be quite substantial. You can now be issued with a Fixed Penalty Notice of 6 points and a £200 fine or your case could go to court where you could be disqualified from driving and get a maximum fine of £1,000.

There are a number of defences which can be employed should they be able to be proven. These include errors in police procedures, using a device to call 999 in an emergency and being able to provide evidence that shows you were not using a function.
