How long do will disputes take?

We will aim to settle your claim as quickly and efficiently as possible.  Each of these cases are very fact specific and how long a case takes to settle will depend on several factors including the conduct of the parties and the type of dispute.

Do you offer no win no fee for will disputes?

Yes, we do offer No win, no fee (Conditional Fee Agreements or CFAs) on a case by case basis. Our experts shall discuss funding option with you during the initial consultation (up to 1 hour).

Can you act for clients outside Derby & Yorkshire?

Yes. We act for clients across England and Wales and we can conduct all meetings online.  We can also act for clients who live abroad if the estate in dispute is in England and Wales.

How do I start a will dispute?

Can I challenge a will if probate has already been granted?

Yes. Flint Bishop regularly assists clients who wish to challenge a will after probate has been granted. We can advise on whether a caveat, claim, or application to court is still possible, depending on your circumstances and the type of claim.

Is there a time limit for contesting a will?

Yes. Some claims have strict deadlines for example:

Inheritance Act claims: 6 months from the grant of probate

Validity disputes: No strict limit, but acting quickly is essential

Flint Bishop can advise immediately on which deadlines apply to you.

Can Flint Bishop stop an executor from distributing the estate?

Yes. We can quickly enter a caveat to stop probate being issued or apply for court orders where appropriate. Acting early can prevent estate assets from being distributed before your claim is resolved.

Will I have to go to court for a will dispute?

In most cases, no. Flint Bishop resolves the majority of disputes through negotiation or mediation. Court proceedings are only required if the parties cannot reach agreement.

What happens if the executor is acting unfairly?

Flint Bishop can challenge an executor’s actions, remove them if necessary, or compel them to disclose information. Executors must act in the best interests of the estate.

Can I bring a claim to receive more financial support under a will?

You can bring a claim under the Inheritance (Provision for Family and Dependants) Act 1975 if you are an eligible to bring a claim and the will fails to make reasonable financial provision for you.  We can advise you on whether you have a claim in the initial consultation.

Can siblings dispute a will?

Absolutely. Many disputes are between siblings who disagree about:

  • The validity of the will
  • How assets are divided
  • Whether one sibling exerted influence
  • Executor decisions

We handle these disputes sensitively while protecting your legal rights.

What if there is no will at all?

If someone dies without a will, the estate is distributed under intestacy rules. Flint Bishop can help you challenge the distribution and this is something we can discuss with you at the initial consultation.

Is there a cost risk if my will dispute is unsuccessful?

There can be, but Flint Bishop provides:

  • Transparent cost discussions
  • No win no fee options (where appropriate)
  • A clear strategy to minimise risk
  • Many disputes settle before court, reducing exposure to costs.

Can stepchildren or unmarried partners dispute a will?

Yes. Certain family members — even if not related by blood — maybe eligible  if they were financially dependent on the deceased. We can assess whether you have a qualifying claim.

What if the will was changed shortly before death?

  • Last minute changes made to a will can raise red flags around:
  • Capacity
  • Coercion
  • Fraud
  • Suspicious circumstances

Flint Bishop frequently investigates changes made close to death and has successfully challenged many of these wills.

Can I contest a will if I don’t live near your offices?

Yes. We represent clients nationwide and nationally, handling all meetings online via video, phone, and secure document sharing.

Do contested wills ever settle quickly?

Yes — many disputes settle without the need for court proceedings once the key issues are identified. Flint Bishop’s proactive approach helps shorten timescales significantly.
