Trading Standards officers will investigate alleged offences and breaches and have many of the same powers as the police to do so.

You may be invited to attend an interview under caution and if this is the case then you should seek immediate expert advice as what you say in that interview may have a significant impact on the outcome of an investigation or prosecution.

Case study

Contested trial defence for client in children’s toy market

Our client, who has a major presence in the children’s toy market, was accused of selling toys which were in breach of flammability requirements.

The case was ultimately prosecuted in the Magistrates’ Court. Following a contested trial which led to experts being called on behalf of prosecution and defence, our client was acquitted of all offences they had been charged with and the Court made an order for their costs to be paid out of Central Funds.
